Section One: Foreclosure Nuts and Bolts Presented by Cam Scott (1 hour)
This presentation will focus on the very basics in foreclosure law. It is a brief introduction to everything from the filing of the Appointment of Substitute Trustee to the filing of the final account and final report. There is also a brief historical breakdown of how we got to be the only state in the Union with has been termed "quasi judicial foreclosures"
Section Two: Updates and Recent Case Law Regarding Foreclosures Presented by Jeff Bunda (1 hour)
This presentation focused on the issues relevant to contesting a foreclosure - what can be heard, and what can't. This seminar covers recent case law developments and litigation strategies involving contested foreclosures. Mr. Bunda also covers on vehicles used to unwind foreclosure sales, both from the creditor's and the debtor's perspective.
Section Three: Foreclosure Defense and Other Related Litigation Issues in Foreclosure Presented by John Scarbrough (1 hour)
This presentation addresses how to advocate for a client prior to their foreclosure hearing and at the foreclosure hearing, but it primarily discusses post-foreclosure litigation where a cause of action exists against the mortgage servicer for proceeding with a foreclosure sale in violation of various laws.
