Program & Speaker:

In this one-hour presentation, we will analyze and attempt to solve the various ethical and strategic problems that can arise when we determine that our clients are lying, or may be lying, to us, the other side or the Court.  The discussion will implicate criminal, regulatory and civil considerations and situations, and rely on hypotheticals modeled on Mr. Terpening's own experience. 

 

Specific coverage will include:

·         What to do when you believe your client is intent on lying under oath at trial

·         What happens and what to do when you discover that your client's lies have inadvertently caused you to make misstatements in filed pleadings

·         Suggested approaches to confronting your client without permanently damaging your professional relationship

·         How to handle clients who may be tampering with witnesses or documents, or otherwise obstructing justice

·         Parallel proceedings: criminal implications of dishonesty in regulatory and civil matters

·         Detailed discussion of the applicable Ethics Rules
