This CLE program will cover information management and ethical implications specific to social media and has a broader scope intended to introduce attorneys to this increasingly prevalent source of discoverable electronically stored information and the obstacles that often arise. This presentation covers the biggest 2012 social media cases: People v. Harris (June 2012) (Stored Communications Act), State v. Tienda (Feb. 2012) (authenticity) and Tompkins v. Detroit Metropolitan Airport (Jan. 2012) (most recent "private portions of social media profile" case building upon McMillen and Romano). The main parts of this presentation include:
