Want To Be My Friend? Ethical Implications of Social Networking and E-Discovery

This CLE program will cover information management and ethical implications specific to social media and has a broader scope intended to introduce attorneys to this increasingly prevalent source of discoverable electronically stored information and the obstacles that often arise. This presentation covers the biggest 2012 social media cases: People v. Harris (June 2012) (Stored Communications Act), State v. Tienda (Feb. 2012) (authenticity) and Tompkins v. Detroit Metropolitan Airport (Jan. 2012) (most recent private portions of social media profile case building upon McMillen and Romano). The main parts of this presentation include:

·          Social Media Discovery: Why, Where, What and Who

·          The How of Social Media Discovery

o    Authenticity challenges and 'liking' social media collection

·          Social Media Ethics & Tips

o    Ethics

§  Friending through false pretenses

§  Cases in which judges and attorneys have faced ethical violations for posting material on Facebook (e.g. an attorney posting that the judge is an 'evil, unfair, witch')

o    Tips

§  Information management best practices and usage policies

§  How to set policies to control access and monitor usage within the organization
